1. Definitions

1.2 “Client” refers to the individual or entity using our services.
1.3 “Service” refers to the assistance provided by Friesian Market, including finding, verifying, and facilitating the purchase of Friesian horses.
1.4 “Seller” refers to the breeder or entity selling the horse.

2. Scope of Services 

2.1 Friesian Market connects clients with horse breeders and sellers to facilitate the purchase of Friesian horses.
2.2 Our services include finding suitable horses, verifying seller information, arranging communication, and coordinating transportation.
2.3 Friesian Market does not own the horses listed on the website and acts as an intermediary between the buyer and the seller.

3. Commission and Fees 

3.1 Friesian Market charges a 10% commission on the final purchase price of the horse.
3.2 A non-refundable fee of €500 (excluding VAT) is required upon signing the service contract. This fee covers consultation, searching for suitable horses, and correspondence with sellers.
3.3 The client must pay the purchase price of the horse directly to the seller. This amount is separate from any fees charged by Friesian Market.
3.4 Health check costs and other related expenses are not included in Friesian Market’s service fees and must be agreed upon between the buyer and seller.

4. Client Obligations 

4.1 The client must provide accurate information about their requirements and expectations for the horse.
4.2 The client agrees to pay the service fee and commission promptly as outlined in the agreement.
4.3 The client acknowledges that requests incompatible with a breed’s characteristics may not be processed.

5. Service Validity 

5.1 The service agreement remains valid for two months or until Friesian Market introduces up to five horses that meet the client’s stated requirements, whichever comes first.
5.2 If the client fails to select a horse within the validity period, a new agreement and fee may be required.

6. Disclaimer of Warranties 

6.1 Friesian Market does not guarantee the availability of specific horses or the suitability of a horse for the client’s intended purpose.
6.2 While we strive to provide accurate information, Friesian Market is not responsible for errors, omissions, or misrepresentations by sellers.
6.3 Health checks and certifications are the responsibility of the buyer and seller.

7. Limitation of Liability 

.1 Friesian Market is not liable for any disputes, damages, or losses arising from the purchase, transportation, or use of a horse.
7.2 The client assumes full responsibility for ensuring the horse’s suitability and condition before purchase.

8. Cancellation and Refunds 

8.1 The €500 service fee is non-refundable under any circumstances.
8.2 If the client terminates the agreement before purchasing a horse, Friesian Market reserves the right to retain the commission for any services rendered.

9. Intellectual Property 

9.1 All content on Friesian Market, including text, images, logos, and designs, is the property of Friesian Market and protected under applicable copyright laws.
9.2 Clients may not reproduce, distribute, or use any content from the website without prior written permission.

10. Privacy Policy 

10.1 Friesian Market is committed to protecting your privacy. Personal information provided by the client will only be used for the purposes of delivering our services.

11. Governing Law
